DOLE issues pay rules for June 14, 2010 holiday

Monday, June 14, 2010 has been declared a regular holiday nationwide this year in lieu of Saturday, June 12 (Independence Day), the Department of Labor and Employment (DOLE) said today.

Labor and Employment Secretary Marianito D. Roque said that despite the holiday, the time-honored Independence Day celebration at the Rizal Park in Manila, along with the other nationwide events in commemoration of the 112th Anniversary of the Proclamation of Philippine Independence, will proceed on June 12, 2010 as scheduled.

The Labor and Employment Chief said that the government had earlier declared the regular holiday on June 14, a Monday, in as much as the annual commemoration of the Philippines' Independence Day on June 12 falls on a Saturday this year. He said this is by virtue of Presidential Proclamation No. 1841 issued on June 21, 2009, based on Republic Act (RA) No. 9492 which provides that, "holidays, except those which are religious in nature, are moved to the nearest Monday unless otherwise modified by law, order or proclamation."

Roque thus reiterated to the country's employers in the private sector the regular holiday pay rules to be applied during the regular holiday on Monday, June 14, 2010, as follows:

1. If the holiday falls on an employee’s regular workday:
   1. - If worked, the employee is entitled to 200% of his [or her] basic wage for the first eight (8) hours and, for work in excess of the 8 hours, to an additional 30% of his or her hourlyrate on the said day.
   2. - If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.
2. If the day is the employee’s rest day:
   1. - If worked, the employee is entitled, for the first 8 hours, to 200% of his or her daily rate plus 30% and, for work in excess of 8 hours, plus 30% of his or her hourly rate on said day.
   2. - If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.
3. Where the day immediately preceding the holiday is a non-work day in the establishment or the scheduled rest day of the employee, he or she shall not be deemed on leave of absence on that day, in which case he or she shall be entitled to the holiday pay.
